Data gathered by the Iranian Kurdistan Human Rights Watch (IKHRW), featuring more than 800 documented cases, demonstrates that this phenomenon is not an exception but a persistent pattern\u2014one that simultaneously challenges fundamental human rights, the credibility of local actors, and the efficacy of international institutions.<\/p>\n<p data-path-to-node=\"8\">What distinguishes these cases from isolated incidents is their legal character. According to the &#8220;International Convention for the Protection of All Persons from Enforced Disappearance,&#8221; depriving an individual of their liberty followed by a refusal to provide information regarding their fate or whereabouts constitutes an enforced disappearance\u2014a behavior that, if organized, can escalate to the level of a crime against humanity. In many examined cases, individuals\u2014often adolescents and young adults\u2014are deprived of any contact with their families after recruitment or abduction, held in closed structures, and subjected to various forms of abuse and torture beyond the reach of independent oversight.<\/p>\n<p data-path-to-node=\"9\">Groups such as PJAK, Komala, the Democratic Party of Iranian Kurdistan (KDPI), and PAK have long presented themselves as political actors, yet field evidence reveals a severe rift between their claims and their actions. These groups not only face persistent allegations regarding forced recruitment and the utilization of minors but have also, in numerous instances, completely severed the link between members and their families\u2014a situation that effectively places them in a position of &#8220;absolute control.&#8221; In human rights literature, such control is a clear indicator of enforced disappearance and a violation of the right to family life.<\/p>\n<p data-path-to-node=\"10\">This contradiction becomes more prominent when looking at the formal commitments of these groups themselves. Several of these entities have accepted and committed\u2014within international frameworks, including declarations made to Geneva Call\u2014to refrain from using children in armed conflict and to cease gender-based violence. This implies that at the time of signing these deeds, they acknowledged the commission of these inhumane acts based on provided evidence. In contemporary international humanitarian law, these commitments are recognized as &#8220;accepted standards of conduct.&#8221; The ongoing reports of minor recruitment, forced detention, and restricted communication with the outside world suggest that these commitments are either not implemented or are selectively ignored. Under these circumstances, the issue is no longer just a violation of human rights but the delegitimization of voluntary mechanisms designed to regulate the behavior of armed groups.<\/p>\n<p data-path-to-node=\"11\">The responsibility for this situation does not lie solely with the armed groups. The Kurdistan Regional Government (KRG) of Iraq, as the authority exercising effective control over parts of this geography, cannot cite political complexities as a justification for inaction. The overt presence of bases and the free movement of members of these groups in certain areas raise the question of whether the commitment to prevent the use of territory for harmful acts against the nationals of other countries is being seriously enforced. In international law, &#8220;knowingly passive&#8221; behavior in the face of such activities can incur international responsibility.<\/p>\n<p data-path-to-node=\"12\">At a higher level, the central government of Iraq faces a similar challenge. Allowing the formation of semi-independent armed structures within official borders not only undermines national sovereignty but also contradicts the country\u2019s obligations under fundamental documents such as the International Covenant on Civil and Political Rights (ICCPR). Effective control over borders and the prevention of the forced movement of individuals is the minimum expectation of a state member of the international community.<\/p>\n<p data-path-to-node=\"13\">In this context, Iran&#8217;s diplomatic apparatus cannot settle for general statements. Effective protection of nationals requires pursuing specific cases through bilateral and multilateral mechanisms, utilizing capacities such as international notices, judicial cooperation, and targeted diplomatic pressure. Without turning these cases into a &#8220;continuous legal demand,&#8221; the likelihood of the current situation persisting will remain high.<\/p>\n<p data-path-to-node=\"14\">Perhaps the most serious vacuum, however, is seen at the level of international institutions. The silence or lack of attention from institutions that identify as global defenders of human rights risks the formation of a double standard\u2014where certain violations are less visible due to political complexities or ideological portrayals. If mechanisms such as the dispatch of independent fact-finding missions or access for institutions like the International Committee of the Red Cross (ICRC) to detention sites are not provided, the concept of international oversight will effectively become hollow.<\/p>\n<p data-path-to-node=\"15\">Ultimately, the issue transcends statistics and reports. Enforced disappearance is the gradual removal of a human being from the legal and social sphere; a state where the individual is deprived not only of liberty but of the &#8220;capability of being known.&#8221; Ending this cycle requires clear minimums: disclosing the list of individuals in custody, guaranteeing communication with families, halting forced recruitment (especially of children), and accepting independent monitoring. Without these actions, any claim of fighting for freedom will remain in stark contradiction to the reality on the ground.<\/p>\n<p data-path-to-node=\"16\">Justice in these cases is not found in the level of statements but in the return of individuals who have been held for years in a state of suspension between being and not being.
