the decisive factor is the transformation of volatile political wills into reliable legal commitments.<\/span><span class=\"\"> The primary question now is not whether an agreement will be reached,<\/span><span class=\"\"> but how it can be shielded from the fate of past fragile accords.<\/span><\/p>\n<h3 class=\"\" data-path-to-node=\"9\"><b data-path-to-node=\"9\" data-index-in-node=\"0\">The Limitations of &#8220;Internationalizing Obligations&#8221; via the Security Council<\/b><\/h3>\n<p data-path-to-node=\"10\"><span class=\"\">The common response in Tehran is a focus on &#8220;internationalizing obligations&#8221; through the <\/span><b class=\"\" data-path-to-node=\"10\" data-index-in-node=\"89\">UN Security Council<\/b><span class=\"\">.<\/span><span class=\"\"> Invoking Article 25 of the Charter and attempting to place any agreement under <\/span><b class=\"\" data-path-to-node=\"10\" data-index-in-node=\"189\">Chapter VII<\/b><span class=\"\"> is understandable from this perspective:<\/span><span class=\"\"> such a resolution can elevate commitments from a political level to a binding legal one,<\/span><span class=\"\"> redefining any breach as an &#8220;internationally wrongful act.<\/span><span class=\"\">&#8220;<\/span><\/p>\n<p data-path-to-node=\"11\"><span class=\"\">However,<\/span><span class=\"\"> imagining that this path alone provides an absolute guarantee is a dangerous simplification.<\/span><span class=\"\"> The same mechanism that creates an obligation is equally susceptible to vetoes and shifts in the balance of power.<\/span><span class=\"\"> The experience of the 2015 nuclear deal and <\/span><b class=\"\" data-path-to-node=\"11\" data-index-in-node=\"261\">Resolution 2231<\/b><span class=\"\"> proved that even a link to the Security Council cannot prevent unilateral withdrawal or political interpretations of commitments.<\/span><span class=\"\"> Therefore,<\/span><span class=\"\"> an effective legal strategy must be multi-layered.<\/span><\/p>\n<h3 class=\"\" data-path-to-node=\"12\"><b data-path-to-node=\"12\" data-index-in-node=\"0\">A Multi-Layered Legal Strategy: Four Essential Steps<\/b><\/h3>\n<ol start=\"1\" data-path-to-node=\"13\">\n<li>\n<p data-path-to-node=\"13,0,0\"><b class=\"\" data-path-to-node=\"13,0,0\" data-index-in-node=\"0\">Treaty Registration:<\/b><span class=\"\"> Beyond Security Council coverage,<\/span><span class=\"\"> any agreement must be drafted as an international treaty registered with the <\/span><b class=\"\" data-path-to-node=\"13,0,0\" data-index-in-node=\"132\">UN Secretariat<\/b><span class=\"\">.<\/span><span class=\"\"> This places the accord within the framework of the <\/span><b class=\"\" data-path-to-node=\"13,0,0\" data-index-in-node=\"199\">Vienna Convention on the Law of Treaties<\/b><span class=\"\">,<\/span><span class=\"\"> strengthening principles such as <\/span><i class=\"\" data-path-to-node=\"13,0,0\" data-index-in-node=\"274\">pacta sunt servanda<\/i><span class=\"\"> (agreements must be kept) and the requirement of good faith implementation.<\/span><\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"13,1,0\"><b class=\"\" data-path-to-node=\"13,1,0\" data-index-in-node=\"0\">Binding Dispute Resolution:<\/b><span class=\"\"> Incorporating mandatory dispute settlement mechanisms\u2014such as referral to international arbitration or the <\/span><b class=\"\" data-path-to-node=\"13,1,0\" data-index-in-node=\"135\">International Court of Justice (ICJ)<\/b><span class=\"\">\u2014can make the cost of violation real.<\/span><span class=\"\"> This is a crucial element missing from most purely political agreements.<\/span><\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"13,2,0\"><b class=\"\" data-path-to-node=\"13,2,0\" data-index-in-node=\"0\">Independent Verification:<\/b><span class=\"\"> Designing an independent verification system,<\/span><span class=\"\"> preferably involving multilateral technical bodies,<\/span><span class=\"\"> is essential.<\/span><span class=\"\"> Without a credible authority to determine compliance or breach,<\/span><span class=\"\"> even the most binding legal texts become arenas for conflicting interpretations.<\/span><\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"13,3,0\"><b class=\"\" data-path-to-node=\"13,3,0\" data-index-in-node=\"0\">Structured Reciprocity (Snapback Clauses):<\/b><span class=\"\"> Inclusion of carefully designed &#8220;conditional reversibility&#8221; or snapback clauses can maintain the balance between deterrence and flexibility.<\/span><span class=\"\"> However,<\/span><span class=\"\"> these tools must be precise; if ambiguous,<\/span><span class=\"\"> they become a source of crisis themselves.<\/span><\/p>\n<\/li>\n<\/ol>\n<h3 class=\"\" data-path-to-node=\"14\"><b data-path-to-node=\"14\" data-index-in-node=\"0\">Leveraging the General Assembly and Economic Linkages<\/b><\/h3>\n<p data-path-to-node=\"15\"><span class=\"\">Furthermore,<\/span> the capacity of the <b data-path-to-node=\"15\" data-index-in-node=\"33\">UN General Assembly<\/b> should not be overlooked. While its resolutions are non-binding, they can generate widespread legitimacy and establish a legal narrative, especially when the Security Council faces political paralysis.<\/p>\n<p data-path-to-node=\"16\"><span class=\"animating\">Additionally,<\/span> linking security commitments to economic and trade regimes\u2014through transparent sanctions-relief mechanisms and contractual guarantees\u2014can incentivize compliance. This shifts the cost of a breach from the abstract political realm to a tangible economic reality.<\/p>\n<h3 data-path-to-node=\"17\"><b data-path-to-node=\"17\" data-index-in-node=\"0\">Conclusion: Legal Diplomacy as the New Victory<\/b><\/h3>\n<p data-path-to-node=\"18\">In this framework, &#8220;victory&#8221; is no longer merely a military concept; it is defined as the successful institutionalization of gains into a set of rules that are costly and time-consuming to alter.
