However, membership in an organized armed group can fall under the definitions of <strong>MOAREBEH<\/strong> <em>(enmity against God)<\/em> or <b>BAGHY<\/b>\u00a0<em>(armed rebellion)<\/em>. The case of Azizi and Moradi is a clear example of this legal challenge.<\/h2>\n<p>&nbsp;<\/p>\n<p><em><b>By Dr. Zana Sadeqi<\/b><\/em><\/p>\n<p>&nbsp;<\/p>\n<h3>Introduction<\/h3>\n<p>&nbsp;<\/p>\n<p>The case of the arrest of two Iranian Kurdish women, <b>Pakhshan Azizi<\/b> and <b>Varisheh Moradi<\/b>, has once again brought the debate on how different legal systems deal with <b>terrorism<\/b> and armed groups to the forefront.<\/p>\n<p>While the group <b>PJAK<\/b> (Kurdistan Free Life Party) initially remained silent, it later provided a different narrative, introducing the two as &#8220;women&#8217;s rights activists.&#8221; This conflicting narrative makes a careful examination even more critical.<\/p>\n<p>The main questions are:<\/p>\n<ul>\n<li>What is the legal status of these individuals?<\/li>\n<li>Can they be considered civil activists, or are they official members of an armed group with a history of terrorist acts?<\/li>\n<li>And from the perspective of Iranian criminal law and international law, what is the appropriate punishment for such crimes?<\/li>\n<\/ul>\n<hr \/>\n<p>&nbsp;<\/p>\n<h3>The Framework of Iranian Criminal Law<\/h3>\n<p>&nbsp;<\/p>\n<p>According to the <b>Islamic Penal Code of 2013<\/b>, the <b>death penalty<\/b> is prescribed only for specific crimes. The most important of these are:<\/p>\n<ul>\n<li><b>Intentional murder<\/b> (<i>Qisas<\/i>) \u2013 Articles 381 to 383.<\/li>\n<li><b>Moharebeh<\/b> \u2013 Article 279: Wielding a weapon to create public insecurity.<\/li>\n<li><b>Baghy<\/b> \u2013 Article 287: An organized armed uprising by a group against the Islamic Republic.<\/li>\n<li><b>Corruption on Earth<\/b> (<i>Efsad fil Arz<\/i>) \u2013 Article 286: Committing widespread crimes against the security and health of society.<\/li>\n<li><b>Rape and specific sexual crimes<\/b> \u2013 Article 224.<\/li>\n<li><b>Widespread drug-related offenses<\/b> \u2013 The Anti-Narcotics Law (1988 and its 2017 amendment).<\/li>\n<\/ul>\n<p>Specifically, civil and social activities are never subject to the death penalty. However, <b>membership in an organized armed group<\/b> can fall under <b>Moharebeh<\/b> or <b>Baghy<\/b>.<\/p>\n<p>&nbsp;<\/p>\n<h3>The Legal Status of Pakhshan Azizi and Varisheh Moradi<\/h3>\n<p>&nbsp;<\/p>\n<p>Based on published reports and documents:<\/p>\n<ul>\n<li>These two individuals were active in the <b>official structure of PJAK<\/b>.<\/li>\n<li>Images of their presence in this armed group have been published.<\/li>\n<li>A <b>BBC Persian report<\/b> even confirmed that PJAK is an armed group with a base and underground tunnels on Iran&#8217;s western borders.<\/li>\n<\/ul>\n<p>Therefore, within the framework of Iran&#8217;s domestic law, they are considered <b>members of an armed group<\/b> and could be subject to Articles 279 and 287 of the Islamic Penal Code.<\/p>\n<hr \/>\n<p>&nbsp;<\/p>\n<h3>PJAK and its International Standing<\/h3>\n<p>&nbsp;<\/p>\n<p>PJAK is a branch of the <b>Kurdistan Workers&#8217; Party (PKK)<\/b>. The PKK is on the list of terrorist organizations in the United States, the European Union, and many other countries.<\/p>\n<p>Over the past two decades, the armed actions of these groups in Iran have led to:<\/p>\n<ul>\n<li>The killing of over <b>700 people<\/b> (70% of whom were civilians).<\/li>\n<li><b>184 Iranian Kurdish children<\/b> between the ages of 9 and 15 were recruited by this group, and many were killed in clashes.<\/li>\n<li>The bodies of many victims were never returned to their families.<\/li>\n<\/ul>\n<p>PJAK&#8217;s methods include:<\/p>\n<ul>\n<li>Forced exile<\/li>\n<li>Threatening families<\/li>\n<li>Abducting children<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3>PJAK&#8217;s Violations of International Law<\/h3>\n<p>&nbsp;<\/p>\n<p>The group&#8217;s behavior constitutes clear examples of violations of peremptory norms:<\/p>\n<ul>\n<li><b>Recruiting child soldiers:<\/b> A violation of Article 38 of the Convention on the Rights of the Child (1989) and its Optional Protocol (2000).<\/li>\n<li><b>Attacks on civilians:<\/b> A violation of Article 8 of the Rome Statute (war crimes).<\/li>\n<li><b>Systematic killing and terrorism:<\/b> An example of Article 7 of the Rome Statute (crimes against humanity).<\/li>\n<\/ul>\n<hr \/>\n<p>&nbsp;<\/p>\n<h3>A Comparative Study: How Countries Deal with Terrorism<\/h3>\n<p>&nbsp;<\/p>\n<p><b>United States<\/b><\/p>\n<ul>\n<li>According to the <b>Patriot Act of 2001<\/b>, membership in a terrorist group is subject to severe prosecution.<\/li>\n<li>Penalties include <b>life imprisonment<\/b> and, in some states, the <b>death penalty<\/b>.<\/li>\n<\/ul>\n<p><b>European Union<\/b><\/p>\n<ul>\n<li>Despite the abolition of the death penalty, collaboration with terrorist groups in countries like France, Germany, and Belgium carries penalties ranging from <b>20 years to life in prison<\/b>.<\/li>\n<\/ul>\n<p><b>Middle East<\/b><\/p>\n<ul>\n<li><b>Saudi Arabia<\/b> has repeatedly carried out mass executions of members of terrorist groups.<\/li>\n<li>In <b>Iraq<\/b>, ISIS members are often sentenced to death or life imprisonment.<\/li>\n<\/ul>\n<p>This comparison shows that Iran&#8217;s handling of PJAK members is on par with, or even more lenient than, many other countries.<\/p>\n<hr \/>\n<p>&nbsp;<\/p>\n<h3>Narrative and Media Warfare<\/h3>\n<p>&nbsp;<\/p>\n<p>The <b>Zeynab Jalalian case<\/b> was a prime example of a changing narrative; images were manipulated to remove a weapon from her hand.<\/p>\n<p>In the case of <b>Azizi and Moradi<\/b>, the same pattern has been repeated: an attempt to portray armed members as &#8220;civil activists.&#8221;<\/p>\n<p>&nbsp;<\/p>\n<h3>Conclusion<\/h3>\n<p>&nbsp;<\/p>\n<p>Based on:<\/p>\n<ul>\n<li>Statements from PJAK<\/li>\n<li>Reports from credible media outlets (including BBC Persian)<\/li>\n<li>The admission of PKK officials<\/li>\n<li>On-the-ground evidence<\/li>\n<\/ul>\n<p>Pakhshan Azizi and Varisheh Moradi are not civil activists but rather members of an organized armed group. In Iran&#8217;s domestic law, their status could lead to a death sentence under <b>Moharebeh<\/b> or <b>Baghy<\/b>.<\/p>\n<p>In international law, PJAK&#8217;s actions, from the <b>recruitment of child soldiers<\/b> to <b>attacks on civilians<\/b>, are examples of international crimes.
